General Terms and Conditions Firetasty. (Dutch version)

ARTICLE 1 – Applicability
These general terms and conditions apply to every offer from Firetasty and to every distance contract concluded between Firetasty and Customer. (Only) when mandatory (consumer law) provisions require this, those mandatory provisions will replace the provisions below.
ARTICLE 2 - The offer
If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable the Customer to properly assess the offer. If Firetasty uses images, these are – to the knowledge of Firetasty – a true representation of the products and/or services offered. However, Firetasty does not provide any guarantee or accept any liability for this.
ARTICLE 3 - The Agreement
The agreement is concluded at the time the Customer accepts the offer on the Firetasty website and after meeting the conditions set therein.
Firetasty may – within legal frameworks – inquire whether the Customer can meet his payment obligations, as well as all those facts and factors that are important for responsibly entering into the distance contract. If Firetasty has good reasons not to enter into the contract based on this investigation, he is entitled to refuse an order or request with reasons or to attach special conditions to the execution.
Firetasty will send the following information to the Customer with the product or service, in writing or in such a way that the Customer can store it in an accessible manner on a durable data carrier:
- the visiting address of the Firetasty branch where the Customer can submit complaints;
- the conditions under which and the manner in which the Customer can exercise the right of withdrawal, or a clear statement regarding the exclusion of the right of withdrawal;
ARTICLE 4 – Right of withdrawal for consumers
Upon delivery of products:
When purchasing products, the Customer, if he is a Consumer, has the possibility to dissolve the agreement without giving reasons for a maximum of fourteen days. This period commences on the day after receipt of the product by or on behalf of the Customer.
During this period, the Customer will handle the product and packaging with care. He will only unpack or use the product to the extent necessary to assess whether he wishes to keep the product. If he exercises his right of withdrawal, he will return the product with all accessories supplied and - if reasonably possible - in the original condition and packaging to Firetasty, in accordance with the reasonable and clear instructions provided by Firetasty.
When providing services:
When providing services, the Customer has the option to cancel the agreement without giving reasons for a maximum of fourteen days, starting on the day the agreement is concluded.
In order to exercise his right of withdrawal, the Customer will follow the reasonable and clear instructions provided by Firetasty with the offer and/or at the latest upon delivery.
ARTICLE 5 - Costs in case of revocation
If the Customer exercises his right of withdrawal, the costs of return will in any case be borne by him.
If the Customer has paid an amount, Firetasty will refund this amount as soon as possible, but no later than 30 days after the return or cancellation.
ARTICLE 6 - Exclusion of the right of withdrawal (unless mandatory consumer law rules provide otherwise)
Exclusion of the right of withdrawal applies to the following products:
- which have been created by Firetasty in accordance with the Customer's specifications; b. which are clearly personal in nature;
- which by their nature cannot be returned or are no longer in new condition due to any damage;
ARTICLE 7 – Conformity, Warranty and Liability
Firetasty guarantees that the products and/or services largely comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability and the statutory provisions and/or government regulations in force on the date the agreement was concluded. Any liability of Firetasty is limited to 3 times the Purchase Price of the product or service that was purchased, but in any case to an amount of € 1,000.-. Consequential damage is fully excluded. Damage for which exclusion is not (fully) possible falls under Firetasty's insurance cover, whereby the amount of that liability is limited by the amount of the coverage of Firetasty's insurance (minus deductible).
ARTICLE 8 - Delivery and execution
Firetasty will exercise the greatest possible care when receiving and executing orders for products and when assessing applications for the provision of services.
The place of delivery is the address of Firetasty.
If delivery is delayed, or if an order cannot be fulfilled or can only be fulfilled in part (always with an excess of at least 50%), the Customer will be notified of this no later than one month after placing the order. In that case, the Customer has the sole right to terminate the agreement without costs and the right to any additional compensation for damages under application of the limitations set in Article 7 regarding the level of liability.
In the event of dissolution in accordance with the previous paragraph, Firetasty will refund the amount paid by the Customer as soon as possible, but no later than 30 days after dissolution.
If delivery of an ordered product proves impossible, Firetasty will make every effort to provide a replacement article. At the latest upon delivery, it will be stated in a clear and comprehensible manner that a replacement article is being delivered. The right of withdrawal cannot be excluded for replacement articles. The risk of damage and/or loss of products rests with the Customer up to and including the moment of delivery to the Customer, unless expressly agreed otherwise or prohibited by mandatory law.
ARTICLE 9 – Disputes
Agreements between Firetasty and the Customer to which these general terms and conditions apply are exclusively governed by Dutch law (with the exclusion of international treaties) and only the court of Overijssel has jurisdiction to hear any disputes.
